第十九节 业主提前占有工程
有些合同中会规定业主可以在合同关闭前占有全部或者一部分承包商已经完成或者部分完成的工作，这种情况称为提前占有（Beneficial Occupancy）。业主提前占有工程的目的有各种各样，如为了交给第三方检验，也可以是自己使用。提前占有的情况可能是以下但不仅限于以下一些：
- 一个房间、结构或者一部分场地
- 现场的一部分系统，如排水系统
- 街道、道路或者是停车场等业主可能提前使用的工程
但是提前占有不能用于业主占有工程的某部分构件，如钢筋混凝土、钢结构、管线等。
提前占有在合同上相对比较重要，因为当业主提前占有工程时，该部分工程的维护责任就从承包商转向了业主。但是承包商仍然负责完成剩余的工程以及修复在业主占有工程中发现的缺陷。
提前占有工程并不构成以下结果：
- 业主接受承包商的任何工程
- 影响工程的保修期
- 免除承包商完成工程的责任
- 解除承包商的保留金或者给承包商增加费用
通常提前占有工程可以按照以下步骤进行：
- 在提前占有工程之前，业主要和承包商共同对准备占有的工程的状态进行验收，指出其中未完成的部分或者是存在缺陷的部分。
- 咨询师书面通知承包商准备占有工程的日期，一般在合同中会规定咨询师或者业主需要提前通知的天数。通知中一般要包括以下一些内容：
1. 清楚的写明业主准备占有的工程的位置和内容
2. 表明工程中未完成项和存在缺陷项的消项单。
3. 关于业主占有工程后维护责任的清楚的陈述
4. 业主准备占有工程的日期
表19.1所示是一个提前占有通知的格式：

Effective upon the customer taking Beneficial Occupancy, you are relieved of responsibility for any damage which may occur as the result of the occupancy or use of the work, and of maintenance of work or systems within the area.
Beneficial Occupancy of this area does not constitute acceptance of the work or of the contract. You are
reminded that the warranty duration extends ___________ months from the Final Acceptance of the Project as a whole by the customer. That date is currently forecast to be ___________. We recommend
